Who is behind this, what you commit to and what we commit to

Article 10 of Spanish Act 34/2002 (LSSI-CE, the e-commerce act) requires it, but mostly common sense does: before you trust somebody with the messages that go to your customers, you want to know who they are.

“Operaria” and “FlexigoTech” are trading names of this company. The company that invoices you, that answers for your data and that you complain to is always the same one: the one above.

What the service is

Operaria builds, rehearses and runs automated processes for your business (appointment reminders, chasing quotes, sending invoices to your accountant and the like) on your own accounts and tools, with your express permission and only for what you ask us to do.

Terms of service

This is what you agree to when you sign up. It is written to be read, not to hide anything.

1. What you are buying. A number of live processes according to your plan, built by us from what you tell us and approved by you after watching them rehearse. No process goes live without your explicit go-ahead.
2. What you pay, and from when. The monthly fee published on the pricing page, plus VAT. It does not start counting until the day your first process does its first real piece of work and we confirm it. If we have not managed it within 45 days, it is cancelled with nothing charged.
3. The savings guarantee. If the measured saving comes in under your fee two months running, the next month is not charged. How it is measured is on the guarantees page.
4. Cancelling. Whenever you like, in one click from your dashboard or by writing to us. No lock-in and no notice period. Your processes stop straight away and your data is deleted after 30 days.
5. Your accounts. The access you give us (calendar, WhatsApp, spreadsheet and so on) is used only for your processes, stored encrypted, and you can withdraw it whenever you like. You remain the holder of those accounts and of their contracts with Google, Meta or whoever.
6. What we do not do. We do not handle health data or other special categories, we do not send messages to anyone who has asked not to receive them, and we do not use your data or your customers' data for anything other than your own process.
7. If something goes wrong. We undertake to tell you, to fix it and to make sure nobody receives the same thing twice. Our liability for damages is limited to the fees paid in the previous twelve months, except in cases of wilful misconduct or gross negligence, and never covers loss of profit. None of this limits the rights the law gives you as a consumer, if you are one.
8. Changes. If we change these terms or the prices, we will tell you by email 30 days in advance, and you can cancel before then at no cost.

Intellectual property

The software, the brand and the texts of Operaria belong to Flexibles y Accesorios Gobe, S.L. The process specs we write for you are yours: if you leave, you take them with you.

Governing law and jurisdiction

Spanish law. For any dispute, the courts of Barcelona, unless you are a consumer, in which case the courts where you live.
